Privacy Policy

Lime Capital Finance Ltd, trading as Lime Finance, (“We”, “us”, “our”) is the data controller and is registered under the Data Protection Act 1998. 

This privacy policy applies to any natural person (“you”, “your”) who supplies data to us, via our website, via their solicitors or otherwise. In this policy you can learn what kind of information we collect, how we collect information, when & how we use the information, how we protect the information and the choices and rights you have with respect to your personal information.

Personal Information collected through this website and how it is used

If you visit our website we collect your IP address and details of your visit such as the date and time, your location and the web browser you used. We also use Cookies (small files that are placed on your computer) to track the pages you visit on our website and how you arrived at our website and to store preferences so that you don’t have to re-enter them each time you visit. We use the information collected to improve our service or to track the success of marketing initiatives. We do not use cookies that can be viewed publically and we do not track your behaviour outside our web site. We do not store your personal information on any cookies. (See note 1 for more details)

If you complete and submit the contact us form we use the information you provide to respond to your enquiry. We do not make the information available to anyone else.

Personal Information collected from your solicitor or directly from you and how it is used

When you request a litigation loan via your solicitor, your solicitor will transfer your personal data to us so that we can process and manage your litigation loan. Your solicitor will send us your full name, address, date of birth, email address, telephone numbers and basic details of your litigation including an estimate of the settlement value to you. Your solicitor will also send us certified copy of your ID verification documents so that we comply with ID checking and anti money laundering regulations. 

Credit Search – we use your information to undertake a credit search prior to offering you a loan. This search does not leave a so called “hard footprint” on your credit file. The search provides us with information on your credit history and the credit reference agency’s opinion (credit score) of your credit status. We use this as one component in our decision making process and if we refuse credit based on your credit score we will inform you and tell you which credit reference agency we used. During the course of the loan, you and /or your solicitor may also directly send us amended or additional personal information via login to our website, email, telephone or otherwise.

We use your personal information to manage your loan account and to communicate with you (such as sending you regular loan statements). We will not sell your data to any 3rd party and we do not use your data to try to sell you other services or products. We do share your data with your solicitor to the extent necessary to manage your loan and so that your solicitor can act as your agent and so that your solicitor can fulfil their obligations as loan guarantor. We will only share your data with other 3rd parties directly involved in our service provision and then only to the extent that 3rd parties require such data. In particular, if we collect your bank details these are not shared with any 3rd party except our own clearing bank in order to make payments to you.

Data Security

We have established physical, managerial, procedural and technological safeguards to ensure that your data is protected and secure. In particular, we use SSL (secure socket layer) internet security protocols to collect and store your data. This is the most advanced internet security currently commercially available for data collection. However, we cannot guarantee that unauthorised persons will always be unable to defeat our security measures.

How long we keep your information

If you have a loan with us we store your information for 7 years after your loan is closed. If you don’t have a loan with us we store your information for 12 months. We then delete our computer records and shred paper records. 

Your rights to view, correct, delete, stop processing, transfer data and to opt out of communications

If you have a loan account with us, then you have a password to login to our website and view / amend much of the personal data we hold on you. You always have the right to:

  • See the personal data we hold about you
  • Change / correct any relevant data
  • Ask us to delete any personal data we hold (we cannot delete data required to deliver an existing loan or to meet legal & regulatory obligations)
  • Ask us not to further process data we hold (the validity of existing loans is not affected but we will not process your data for any new service or purpose)
  • Opt out of future communications from us (we will continue to send communications required to meet legal & regulatory obligations in connection with a running loan)
  • Receive your data from us in a format that can be easily transferred to another data controller or to ask us to directly make a data transfer in a standard format to another data controller

When we may transfer your information

We will transfer your information when required by law or as a matter of vital interest or as needed in connection with the transfer of our business assets (for example, if we are acquired by another firm).

NOTES

  1. The use of cookies is relatively standard.   2. Credit reference agencies keep a record of our enquiries and may record, use and give out information we give them to other lenders, insurers and other organisations. This also applies to fraud prevention agencies if you give us false or inaccurate information or we suspect fraud. The information may be used to make assessments for credit and to help make decisions on you and members of your household, on credit, motor, household, life, and other insurance facilities (including handling claims), for debt tracing and to prevent fraud and money laundering. Information held about you by the credit reference agencies may already be linked to records relating to one or more of your partners where a financial “association” has been created. Any enquiry we make at a credit reference agency may be assessed with reference to any “associated” records.
